Your record is not the whole story

A record can close doors on a checkbox. This kit helps you walk back through them: write a calm letter of explanation, practise a short, honest answer for the interview, gather the papers that prove how far you have come, and know your rights when an employer runs a background check.

Know your rights on background checks

They need your permission

An employer must tell you in writing that it may use a background report, and it “must also get your written permission before asking the company to run a background check.” Federal Trade Commission

Before they turn you down

If the report may cost you the job, “they must give you a copy of the report and a ‘Summary of Rights’” under the Fair Credit Reporting Act first. That notice is your moment to send this letter and fix mistakes. Federal Trade Commission

Mistakes can be fixed

“You have the right to dispute with the background reporting company any information on your report that’s inaccurate or incomplete,” and to an additional free copy of your report if you ask “within 60 days of the employer’s decision.” Federal Trade Commission

An arrest is not a conviction

“An employer cannot refuse to hire people simply because they have been arrested. The fact that a person was arrested is not proof that they committed a crime.” Background companies generally may not report arrests that did not lead to a conviction if they are more than seven years old, though convictions can be reported indefinitely. Be ready to explain

An employer may ask about “education, job training programs while incarcerated, family and community support, employment and character references, and other relevant rehabilitative efforts. This information can make a difference in some situations.” That is what step 3 is for. EEOC

Fair chance hiring

“With only certain exceptions, a federal government agency or a federal contractor may not ask whether you have a criminal record until after they have made you a conditional job offer.” Some states and cities have similar “ban the box” laws for other employers. EEOC, on the Fair Chance to Compete for Jobs Act

Employers also may not treat people with similar records differently because of race, national origin or another protected trait, and the EEOC’s guidance asks employers to weigh the nature of the offense, the time that has passed and the nature of the job, rather than rule people out on a checkbox.

In the interview

  1. Never lie about your record. A lie that turns up later can cost you the job, even when the record itself would not have.
  2. Keep it short. A few sentences on what happened, more on what you have done since. You do not have to relive it.
  3. Turn back to the job. End on the skills and reliability you bring, then let them ask questions.
  4. Bring copies of your certificates and reference letters, in case they help.
  5. Practise out loud, with a friend, a mentor or a mirror, until it feels calm.

Clearing or sealing a record

Many states let people seal or expunge some records, and some do it automatically. The rules are different in every state. A free legal aid office can tell you whether yours qualifies: find one near you at LawHelp.org.

If you think it was discrimination

The U.S. Equal Employment Opportunity Commission (EEOC) is free, and you do not need a lawyer to file. Call 1-800-669-4000, TTY 1-800-669-6820, ASL video phone 1-844-234-5122, or read its resources on arrest and conviction records. For private employers the deadline is usually 180 days, or 300 where a state or local agency enforces a similar law.
